DUI Brian D. Rogers: Unfortunately, many catastrophically injured people are the victims of this clearly preventable crime. And because it's a crime, you will need to work as a victim with the district attorney's office. The district attorney will prosecute the crime for this state. The defendants will often plead the Fifth Amendment which means they're not going to answer questions that may incriminate them. That and the pending criminal prosecution is going to prevent the victim or the victim's family from getting information they need and want. You need to work closely with the district attorneys office or the victim advocacy office. In fact MADD Georgia has a victim advocacy program that will help you stay informed and know what's going on with the criminal prosecution. Driving under the influence also gives rise to punitive damages. Punitive damages are those damages that are given to deter or punish the conduct. They are different than compensatory damages which are meant to compensate the injured party for the harm done. The Georgia General Assembly has set the cap for punitive damages $250000.00. However that cap does not apply to DUI cases. What's important to understand, and when prosecuting a civil DUI case is that evidence is needed both from the criminal prosecution and your own investigation. Young drivers are a high-risk group, partially because they are young and just learning the rules, but that is not the only reason. Young drivers often think they are invincible; that the crashes caused by teenage drinking and driving reported on the news will never happen to them. According to the Insurance Institute for Highway Safety, the youngest drivers are less likely to drive after drinking, but are more likely to crash when they do, because of inexperience with both alcohol and driving and the combination of the two. In 2003, 27 percent of 16-20-year-old passenger vehicle drivers fatally injured in crashes had high BACs (0.08 percent or more). The percentage of high BACs was much lower among females (13 percent) than among males (33 percent), and also was lower among 16-17-year-old drivers (16 percent) than among 18-19-year-old (30 percent) or 20-year-old (35 percent) drivers. New California Law for 2009: DUI Zero ToleranceApr 03, 2011
steigerlaw.typepad.com This new law prohibits a convicted DUI offender from operating a motor vehicle with a blood alcohol level (BAC) of .01 percent or greater while on probation for DUI. The law requires the driver to submit to a Preliminary Alcohol Screening (PAS) test, a portable breath test to determine the presence of alcohol. If the driver refuses, or if the driver submits and has a BAC of .01 or greater, a citation will be issued, the driver's license will be taken and driving privileges will be suspended.
