governor bill richardson received a national award for new mexico's fight against drunk driving. but tonight we look into a problem tracking dwi convictions. statewide -- court records indicate 76- percent of dwi cases resulted in convictions last year. but mvd data -- the official record --tells a far different story. gadi schwartz is live in santa fe to explain. on average around 76 percent of dwi's in new mexico ended with a conviction in 2009 according to official court records. but the mvd seems to think the courts are only convicting about 50 percent of drunk drivers. today governor richardson says new mexico is making progress in the fight against dwi. richardson received an award from the national highway and safety bureau- after new mexico went from the worst in the nation when it came to dwi's to the 17th worst for drunk driving. "a lot of other public efforts at drunk busters hotline its working, we need the courts to do better we need the courts to not have so many dismissal rates of those that are guilty." but when we wanted to know about conviction rates -- we found there's a communication issue which could cause problems when it comes to repeat offenders. when a repeat offender goes to court on another dwi charge -- prosecutors must show official proof of a past conviction. the dwi resource center tells us the only official proof is led with the m- vd. the problem is -- conviction paperwork doesn't always make it there. so while court databases show about ...

"i think he's served his time." new tonight---- the brother of the man getting a new trial for a drunk driving crash that killed 5 of his passengers is speaking out. last night the family of the victims spoke about their fears of mario trujillo being released from jail today. trujillo is still behind bars tonight... but his brother says it won't be for much longer. heather mills spoke to both families-- and is here with the story. mario trujillo's brother tells me mario has served his time and deserves to be let out of prison. he says mario has a big heart and no one has suffered as much as he has... but other family members say it's not enough. "there is no way i can pick up the phone and call her" "everyday we have to pass by there, we see the markings. its a reminder every-time we go by there." tim trujillo lost a half-brother.. a cousin.. and three friends in that wreck when mario trujillo veered off a frontage road in wagon mound in july of 2004... and he says having mario in prison is a constant reminder of everything that was lost. tonight we're seeing the first effects of yesterday's state budget cuts. we've learned those cuts could mean trouble for prosecuting drunk drivers. specifically the cuts could lead to a backlog at the lab where the blood of dwi supects is tested. gadi schwartz is live in santa fe with how big a problem this could cause. any time a drunk driver gets his blood drawn- its up to the department of health to test it for alcohol. we aim to have 90 percent done in 8 weeks and its been slowing down because we havnt been able to keep up so right now completing about 70 percent in 8 weeks that means more than a quarter of those blood tests may not be ready by the target date... and that poses a problem for prosecutors dealing with repeat dwi offenders or drunk driving accidents that involve injuries or death.. because they onlhave 60 days to get an indictment. so we asked the bernalillo county da's office what that could mean for some of the 7- thousand dwi cases they take on every year. if we can't get those test results back quickly enough, either we are delayed in charging them , or we don't have the evidence to charge them when it gets to trial, then the defendant is able to walk away. to make matters worse- the department of health's lab is short 3 technicians because of a hiring freeze. and new state rules are taking technicians out of the lab more than ever before to testify in courts all across new mexico

Because a Laurick PCR cannot be brought until there is a second or subsequent DWI conviction, the time bar should not mechanically be applied to deny the petition. However, to obtain the benefit of relaxation of the time limit, a defendant must put forth a prima facie case for relief in his petition itself.
